Appalachian Power Co. v. Hayter

Supreme Court of Virginia
212 Va. 11, 181 S.E.2d 615

Trial court overruled power company’s objections to qualifications of landowners’ expert witness.  Power company also asserted that award was arbitrary and capricious.  Supreme Court affirmed award. Witness qualified as an expert, as he had done business in the area for enough time to become familiar with the facts upon which the value of the property was based.  Amount of award not so excessive as to indicate it resulted from prejudice or corruption.
