Fairfax County filed a petition to condemn water works company located in Fairfax County and Prince William County. Prince William County moved to intervene. Trial court denied motion. Supreme Court affirmed. The institution of condemnation proceedings by one person precluded the right of the other person to condemn the same property. The lower court was correct in applying the rule of first in time, first in right, as between equal parties.
