Board obtained parcel of land through condemnation for courthouse and county court confirmed the action. Eight citizens filed an appeal to the circuit court, which appeal was allowed. Board filed writ of prohibition against citizens and circuit court which the Supreme Court granted. The Court held Board had implied power to acquire land and the citizens had no interests in the land acquired.  Therefore, the citizens had no right to become parties to the condemnation proceeding.
