City of Norfolk v. Campos

In May 1995, City filed condemnation proceeding to condemn Board of Trade Building for a parking lot. Owner was never served notice in any form. City demolished building. Owner made an appearance in November 1995, objecting to jurisdiction for failure to serve him. City nonsuited action and refiled in July 1996. Owner moved in limine to keep City from deducting costs of wrongful demolition from the value of the land on the date of take in July 1996. As the demolition actually had the effect of increasing the value of the land as of July 1996, the motion was granted.
