City of Norton v. Goad

City sought to condemn temporary construction easement to allow City’s Industrial Development Authority to enlarge building leased to AT&T for The Virginia Relay Center. Abutting landowner, over whose land the easement would be located, objected that the construction was for a private purpose. Court held that the City possessed the power of eminent domain. Court further held that the easement was for the lawful public purpose expressed by the legislature’s intent, in authorizing the creation of the Development Authority, of promoting industry by inducing commercial enterprises to locate and remain in the Commonwealth.
