Commonwealth Transp. Comm’r v. Miners Exch. Bank

Commissioner’s highway improvements took away Bank’s two direct entryways, and left Bank with one indirect access from a dead-end service road. At trial for just compensation, Commissioner’s expert’s opinion as to damages was $64,133. Bank’s expert testified compensation was $700,000. Commissioners awarded $425,000. Court did not find award excessive. The award did not exceed the evidence. Further, the complete extinguishment of direct access was compensable.
