Commissioner acquired dealership by eminent domain and paid $2,600,000 into court, which was disbursed to dealership by court order. By time of trial on just compensation, Commissioner showed that dealership did not actually own property due to fatal defects in the land grants in dealership’s chain of title, and dealership had to return the disbursed funds.
