Commonwealth Transp. Comm’r v. Letah Maud Branch

Virginia Circuit Court
16 Va. Cir 50

Commissioner moved to set aside landowner’s just compensation award as excessive, arguing that the commissioners’ award was greater than the landowner’s valuation. Court denied request, holding that the total award must bear a reasonable relationship to the testimony given. The award was not limited to the amount to which the landowner testified, and was within the range given by one of the qualified experts.
