Commonwealth Transp. Comm’r v. Mathur

Commissioner filed condemnation petition to obtain Mathurs’ property. Community Association had easement over the property. Association filed motion for partial summary judgment to apportion such compensation as might be determined. Court denied motion. There would be no determination of Association’s interest until compensation was awarded and paid into court. Once payment of an award occurred, an additional proceeding would adjudicate the rights and claims of all persons entitled to the fund or to any interest or share therein.
