City Council instituted suit to condemn land for street. City code required an effort to purchase land before action was brought. Landowner averred that City made no bona fide offer to buy land and objected to impaneling commissioners. Trial court overruled landowner and Supreme Court reversed and dismissed. The requirement of making a bona fide but ineffectual offer of purchase is jurisdictional. The City having failed to do so, the trial court was without jurisdiction to hear the matter.
