County of Nelson v. Lesesne

Virginia Circuit Court
1997 Va. Cir. LEXIS 734

County objected to commissioners’ award of $30,000 on grounds that it was excessive, arbitrary and capricious, contrary to the law and the evidence and not supported by credible evidence. Court overruled the objections. Landowners’ appraiser was qualified to give an opinion which was supported by the evidence. While the commissioners’ award was 3% higher than the landowners’ appraisal, their report was entitled to great weight and must be confirmed unless good cause was shown against it. The report bore a reasonable relationship to the testimonial evidence.
