CTC v. Crowder

Virginia Circuit Court
20 Va. Cir. 444

Landowner filed exceptions to commissioners’ award. Court held that commissioners’ report was entitled to great weight, was prime facie correct, and must be confirmed unless good cause could be shown against it. If there was no fraud, collusion or improper conduct, the report must be confirmed. The fact that the commissioners saw a videotape of the property showing the extent of the take and the alterations to the residue was not a basis for overturning their findings.
