Ewing v. Bd. of Supervisors

Supreme Court of Virginia
131 Va. 471, 109 S.E. 474

County sought to construct county road through landowners’ property. Several views and reports were made and Board awarded $500 for compensation and damages. Landowners appealed to circuit court. Trial court heard case and awarded same amount as was appealed. Supreme Court affirmed. The viewers and commissioners had the benefit of examining the property. None of the testimony placed compensation above $500. The trial court’s ruling was supported by substantial evidence.
