Exp. Leaf Tobacco Co. v. Richmond
Supreme Court of Virginia
163 Va. 145, 175 S.E. 753
Landowner awarded $30,000 for damages when grade of street was changed which left floor of warehouse eighteen feet above street level. Landowner sought interest at six percent from date of judgment by trial court. City paid amount six months later, but declined to pay interest. Trial court ruled for City, in that interest started seven months after award. Supreme Court reversed. The constitutional provision that allows just compensation to one whose property was damaged required interest to run from the date judgment was final.
