The decision of the Commission, presumed to be correct, to deny a permit was supported by ample evidence and was not arbitrary or capricious. The denial of the permit was not a taking of property without just compensation, because limiting the use of private property to its natural uses in order to prevent harm to public rights, was a reasonable exercise of police power.
