Harris v. Cloverdale Farm

Virginia Circuit Court
14 Va. Cir. 368

Under quick take statute, when the Commissioner paid the compensation  funds into court, the Commonwealth had a defeasible title and the landowner owned the money. Landowner stated his desire to appeal award, but wanted money paid out regardless. Commissioner argued landowner could accept funds and not appeal, or could appeal and not get paid. Court held that regardless of appeal, landowner owned the money and could receive it.
