Hicks v. Anderson

State changed location of road, causing storm runoff to run through landowner’s property, and in turn considerable damage. Landowner sought writ of mandamus to compel Highway Commissioner to conduct condemnation proceedings to ascertain his damages. Supreme Court held that if Commissioner refused to institute proceedings to ascertain landowner’s damages from construction of highway, a mandamus could be awarded to compel institution of such proceeding, which was ordered in this case.
