Highway Comm’r v. McIntyre

Commissioner filed exception to award as being grossly excessive and that one of the commissioners should have been struck from the panel as not disinterested. Landowner and the individual on the panel were both active members and current or former directors of Northern Virginia Livestock Producers, Inc. When asked on voir dire, commissioner responded he could remain fair and impartial. As this was a trade association and not a business, the connection was too insubstantial to be the basis of a disqualification, and the report was confirmed.
