Landowners filed suit for inverse condemnation on October 20, 2004. Governmental action complained of occurred before 1989. An inverse condemnation action is based on an implied contract. By Va. Code § 8.01- 246(4), the statute of limitations is three years. As the statute had run, the case was dismissed.
