Hunter v. Mathews

Hunter made application in county court to build dam and grist mill. Land of Mathews would be damaged. Jury met and set award at $239.81. County court affirmed award. Mathews appealed to circuit court, and second jury deliberated but had trouble reaching a verdict and discussed with Hunter what he was willing to pay. Jury reached a verdict and circuit court set it aside due to the discussions with Hunter and sent matter back to county court. On appeal, Supreme Court reversed circuit court, reinstated county court verdict, and modified it to annul the portion of Hunter being seized in fee of the land to be overflowed.
