Kornegay v. Richmond

City instituted condemnation to acquire land for street widening. Commissioners awarded $7,000 for the take and no damage for the residue beyond benefits that accrued by the improvements. Trial court confirmed the award. Supreme Court affirmed. Report of commissioners was entitled to great weight and must be confirmed unless good cause is shown against it. There was nothing in the record to show commissioners acted out of prejudice or applied wrong principles. Commissioners found widening the street to be more of a benefit than a detriment.

Dissent by Justice Hudgins stating at least one commissioner did not try to  determine fair market value at the time the land was taken.
