Loudon County Bd. of Supervisors v. Lunn

Virginia Circuit Court
24 Va. Cir 13

County paid $2,173,893 into the clerk of circuit court to facilitate quick take. The question arose that between the condemnor and the landowner, who should pay the General Receiver a fee. Court held that it was under no obligation to follow the statutory apportionment of fees for a General Receiver in a condemnation action, citing Va. Code § 8.01-582(2). That did not mean the General Receiver was not to receive a fee. But in accordance with the statute in effect at that time, all costs of the proceeding in the trial court fixed by statute were taxed against the petitioner.
