Nichols v. Central Va. Power Co.

Power Company was a public service company with the power of eminent domain. Company sought to condemn property for transmission lines. Landowner asserted that Company was taking private land for private use, and secured an ex parte injunction against Company. Company was able to get trial court to dissolve the injunction. Supreme Court affirmed. The furnishing of electric power to a public service corporation for distribution to the public is a public use, even if distributed by other persons and corporations.
