Va. Code § 25.1-419 allows the court to award reasonable attorney fees to the landowner, incurred because of condemnation proceedings, when the proceeding is abandoned by the state agency or the state agency cannot acquire the property by condemnation.  The Authority could not acquire the property by condemnation and the landowner’s counsel presented a reimbursement request of $321,094.45. Court heard evidence on reasonableness, and after some correction as to  billing increments and hourly rate, found $292,928.70 to be reasonable reimbursement to the landowner for legal fees, costs and expenses.
