Norfolk & W. Ry. Co. v. Interstate R.R. Co.

State Corporation Commission approved condemnation for extension of track to Interstate over the lands of Norfolk & Western. SCC certified a public convenience or essential public necessity. SCC also certified that the property to be taken was not essential to purposes of Norfolk & Western. Supreme Court affirmed holding that the conclusions of the SCC shall be regarded as prima facie just, reasonable and correct, unless evidence clearly shows to the contrary.
