Norfolk & W. R.R. Co. v. Rasnake

Supreme Court of Virginia
90 Va. 170, 17 S.E. 879

Rasnake brought a civil action against Railroad which sought damages for injury to a road which Rasnake alleged was his. In a prior court action, the court established the road as a public road, which was in effect from its entry. Rasnake had no ownership interest in the road. Therefore, Supreme Court reversed the trial court and the matter was dismissed.

Summary prepared by Judge Jonathan Apgar, 23rd Judicial Circuit in Virginia, for the William & Mary Property Rights Project, Marshall-Wythe School of Law, William & Mary ©2019.
