Pitzer v. Williams

Williams was given statutory authority to erect a dam and carding machine on the banks of the Jackson river by the use of eminent domain. He applied to the county court, and gave notice of the application to the landowner. Matter was removed to the circuit court. Landowner’s son moved to be joined as a defendant, as he lived on the land, and also moved to dismiss the application. Trial court overruled the motion, and son appealed. Supreme Court affirmed. Landowner was a tenant of the whole. Notice to her, as the visible owner, was sufficient.
