Reid Bros. v. Norfolk City R.R. Co.

General Assembly and the City of Norfolk authorized streetcar company to build a double-track electric streetcar line. After construction started, landowners that fronted street sought an injunction to stop work. Ultimately, trial court denied injunction and dismissed bill. On appeal, landowners complained that the increased servitude on the street entitled them to compensation. Supreme Court affirmed. The use of electricity to move streetcars imposed no greater burden on a street than an ordinary horse railway, and was not a material obstruction to travel or a use of the street inconsistent with its dedication.
