Railroad sought to condemn four and one-half acres of landowners’ property to obtain gravel needed for repairs. Railroad’s charter only authorized it to take needed material, and not to condemn land to do so. Trial court dismissed as Railroad was not empowered to condemn land. Supreme Court dismissed case as amount in controversy was below level of its jurisdiction.
