Richmond Fredericksburg & Potomac R. R. Co. v. Richmond

City passed ordinance prohibiting steam locomotives on City streets. Railroad was fined for violation and appealed.  Supreme Court affirmed. Railroad contended ordinance was invalid because it violated Railroad’s chartered rights to run cars by steam the whole length of a street. City responded it had the right to exercise complete and absolute authority in regulating the use of its streets by the Railroad. Court held that the ordinance was within the police power of the City, and that police power had not been unreasonably or oppressively exercised. By only preventing the use of steam locomotives, the City did not impair any contract or violate any chartered rights of the Railroad.
