Richmond v. Kingsland Land Corp.

City was lowering grade of street to accommodate railroad overpass. Kingsland owned three commercial lots. No land of Kingsland was to be taken, but alleys would be closed, and street access affected. Kingsland was awarded damages for two of the lots, which City asserted were still accessible by other means. Trial court granted award and Supreme Court affirmed decision. The evidence supported the award, which showed that the alleys that the City claimed were not traversable were open and used. The loss of access to the lots damaged their value.
