Sch. Bd. of Roanoke City v. Buford

Supreme Court of Virginia
140 Va. 173, 124 S.E. 286

School Board condemned land for new school. Board later changed location of new school, and planned to sell acquired land at a profit. Landowners brought action alleging that, pursuant to statute in effect at that time, title to land reverted back to them. Trial court ruled in landowners’ favor. Supreme Court reversed. Board had taken fee simple title by condemnation, and reversion statute did not apply to a public school board. Any inequity in the result required by the statute was a matter for the legislature.
