Condemnor filed motion in limine to exclude evidence of valuation by landowner’s expert using five comparable sales. Court granted motion. The 28 acre parcel was zoned agricultural. The five comparables were zoned industrial or urban commercial. The court found as a matter of law that the five sales were not sales made under comparable conditions in point of time and circumstances, nor were they similar in locality and character of the land in question.
