State Highway Comm’r v. Bell

Virginia Circuit Court
5 Va. Cir. 467

Condemnor objected to evidence of other comparable sale by different condemnor as there was no showing that the sale was voluntary. Court agreed that evidence should not have been admitted. There was no evidence by the condemnee that this other sale was voluntary and without compulsion. Because the commissioners’ report was based on inadmissible evidence, it required reversal.

Summary prepared by Judge Jonathan Apgar, 23rd Judicial Circuit in Virginia, for the William & Mary Property Rights Project, Marshall-Wythe School of Law, William & Mary ©2019.
