State Hwy. Comm’r v. Irving

Virginia Circuit Court
6 Va. Cir. 62

Commissioner moved to set aside award as excessive. Court stated the report of commissioners was entitled to great weight, was prima facie correct and must be confirmed unless good cause could be shown against it. The report could only be set aside if the commissioners proceeded on erroneous principles, or the amount was so grossly inadequate or excessive as to show prejudice or corruption. Court held that the award was not so grossly excessive that it bore no relationship to the testimony of the witnesses.
