Talbot v. Norfolk

City needed to take portion of landowner’s lot to widen street. Landowner was not seeking any award for another lot not involved in the taking. Commissioners awarded $4,000 for the take. When inquiry was made as to how the damages were reached, testimony showed that the fair market value of the take was reduced by the benefit given to the unaffected lot. Trial court affirmed the award. Supreme Court reversed and remanded. Landowner should be paid the fair market value of the land taken without any reduction for any increased value of the lot not involved in the take.
