Turock Estate, Inc. v. Thomas
Virginia Circuit Court
7 Va. Cir. 222
Corporation argued rezoning from limited commercial to multiple residential was invalid because notices of scheduled public hearings were constitutionally inadequate. Court held the statutory notice requirements then in effect were followed to the letter. Non-conforming use could have continued but it was discontinued for more than two years after the rezoning was accomplished.
Summary prepared by Judge Jonathan Apgar, 23rd Judicial Circuit in Virginia, for the William & Mary Property Rights Project, Marshall-Wythe School of Law, William & Mary ©2019.
