Virginia-Western Power Co. v. Kessinger

Power Company filed exceptions to the report of commissioners in condemnation action to obtain easement for power transmission lines. One exception was that landowners fed commissioners dinner and provided cigars prior to the view. Trial court overruled exceptions. Supreme Court reversed and remanded. Public policy required that a new trial be held when entertainment of commissioners was provided by one party, even though counsel for the Power Company did not express an objection in the presence of the commissioners.
