Virginia Elec. & Power Co. v. Haycox

VEPCO filed petition for condemnation for a portion of landowner’s property. Landowner had a long-term tenant that was a building materials supplier. VEPCO and landowner agreed on value of land to be taken, and argued tenant could not be heard in the matter, as its landlord had settled the suit which then was to be dismissed. Court disagreed. The statute in effect at that time stated that any tenant for a term expiring more than twelve months after the filing of a petition may participate in the proceedings to the same extent as the landlord or owner. Court denied VEPCO’s motion to dismiss.
